In his brief to the court, Marshall had argued that laws that required segregation in schools in a given state did harm to blacks. He requested that the concept of “separate but equal” be struck down as an equalizer before the law. With the future of the Plessy v. Ferguson precedent possibly on the line, the courtroom was packed that day: Hundreds of people stood in line for hours outside the Supreme Court hoping to get a seat to hear the case argued in April 1950.
